These Terms of Service ("Terms") govern your access to and use of the website stand8.ai and its subdomains, services, and tools (collectively, the "Services") provided by Stand 8 ("Stand8," "we," "us," or "our"), through its Stand 8 AI division. By accessing or using the Services, you agree to these Terms.
1. Description of Services
Stand8 provides enterprise technology consulting services. Our Site offers:
- AI Readiness Assessment — an interactive questionnaire that evaluates organizational AI maturity and generates scores, insights, and recommendations
- AI Concierge ("ERIC") — an AI-powered chatbot that answers questions about Stand8's services and capabilities
- Consultation requests — forms to schedule conversations with Stand8 consultants
- Event registration — registration for Stand8 events and workshops
- Internal tools — employee-only workflows (requires authentication)
2. AI-Generated Content Disclaimer
Certain features of our Services use artificial intelligence to generate content, including assessment scores, recommendations, industry classifications, and chatbot responses.
- AI-generated content is provided for informational purposes only and does not constitute professional advice, legal counsel, financial guidance, or a guarantee of any outcome.
- AI outputs may contain inaccuracies, incomplete information, or errors. You should independently verify any information before relying on it for business decisions.
- Assessment scores and maturity levels are based on self-reported data and automated algorithms. They represent a general indication of organizational readiness, not a definitive evaluation.
- The AI Concierge is an automated system, not a human. It cannot make commitments or enter agreements on behalf of Stand8.
- Stand8 does not guarantee the accuracy, completeness, or reliability of any AI-generated content.
3. User Responsibilities
When using our Services, you agree to:
- Provide accurate and truthful information in forms and assessments
- Not use the Services for any unlawful purpose or in violation of these Terms
- Not attempt to probe, scan, or test the vulnerability of our systems
- Not attempt to manipulate, bypass, or inject prompts into our AI systems
- Not use automated tools (bots, scrapers) to access the Services without our written consent
- Not impersonate any person or entity or misrepresent your affiliation
- Not submit content that is harmful, threatening, defamatory, or otherwise objectionable
4. Intellectual Property
- The Site, its content, design, and underlying technology are owned by Stand8 and protected by intellectual property laws.
- The assessment methodology, scoring algorithms, industry benchmarks, and proprietary frameworks (including SCSIM) are owned by Stand8.
- You retain ownership of any data you submit through the Services. By submitting data, you grant Stand8 a limited license to process it as described in our Privacy Policy.
- Assessment results generated for you are provided for your use. You may share or reference them, but you may not represent them as endorsed by Stand8 without written consent.
5. Account Security
Certain features require authentication via Microsoft Entra ID. If you have an authenticated account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAND 8 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services
- Any decisions made or actions taken based on AI-generated content, assessment results, or recommendations
- Any loss of data, business, revenue, or profits arising from use of the Services
- Any errors, inaccuracies, or omissions in AI-generated content
- Service interruptions, downtime, or technical failures
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO STAND 8 IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Indemnification
You agree to indemnify, defend, and hold harmless Stand8 from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
9. Service Modifications and Termination
- We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.
- We may terminate or restrict your access to the Services if you violate these Terms or engage in abusive behavior.
- Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will survive.
10. Third-Party Links
The Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interactions with third parties are solely between you and them.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Services shall be resolved through binding arbitration administered by JAMS in Los Angeles County, California, under its Streamlined Arbitration Rules. You waive any right to participate in a class action.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Services after changes constitutes acceptance.
